These policies explain how Cricket AI handles user data, subscriptions, AI-generated outputs, video analysis, refunds and platform usage.

1. Privacy Policy

1.1 Introduction

Cricket AI ("we", "our", "us") is committed to protecting your privacy and personal information. This Privacy Policy explains how we collect, process, store, use, secure and manage information submitted through the Cricket AI website, platform, mobile application, analysis services, event registrations and related services. By using Cricket AI, creating an account, submitting footage, booking an analysis, subscribing to a package or communicating with us, you acknowledge and agree to the practices described in this Privacy Policy.

1.2 Ownership of User Data

All videos, images, statistics, player information, reports, notes, comments, performance information, uploaded files and related content submitted by users remain the property of the user, parent, guardian, school, club, academy or organisation that uploaded or provided such content. Cricket AI does not claim ownership of user content. Users retain all intellectual property rights and ownership rights in their submitted content, subject only to the limited rights required by Cricket AI to process, analyse, generate reports, deliver services, provide support and maintain the platform.

1.3 Information We May Collect

We may collect personal and service-related information including name, surname, email address, contact number, school, club or academy information, player profiles, age group, playing role, dominant hand, performance statistics, uploaded video footage, extracted video frames, technical analysis notes, reports, subscription status, billing records, usage analytics, device information, browser information, support messages and platform activity data.

1.4 Video Footage Processing and Deletion

Cricket AI analyses uploaded video footage using artificial intelligence, computer vision, automated movement analysis and related technology. Uploaded footage is temporarily processed for the purpose of completing the requested analysis. Cricket AI does not permanently store full uploaded footage after analysis is completed. Full video footage is deleted after the analysis process has been completed, subject to reasonable technical processing time, system queues, backups, failed upload handling, audit requirements or support-related troubleshooting.

Users acknowledge that certain extracted frames, still images, thumbnails, skeletal tracking data, movement markers, timing references, technique checkpoints, statistical outputs, report visuals and analytical metadata may be retained for the purpose of generating and storing the final report, allowing users to review historical analysis, improving report clarity, maintaining service records and providing support. These retained elements do not constitute the complete original video footage.

1.5 How We Use Information

Information may be used to create user accounts, manage subscriptions, process payments, generate cricket analysis reports, assess batting or bowling technique, provide AI-supported insights, identify improvement areas, recommend drills, provide customer support, communicate with users, improve platform functionality, detect fraud or abuse, maintain system security, comply with legal obligations and improve the quality of Cricket AI services.

1.6 AI Training and Improvement

Cricket AI will not use identifiable player footage for external marketing or public display without permission. Identifiable player footage will not be sold to third parties. Anonymised, aggregated or de-identified analytical data may be used to improve system performance, platform reliability, reporting structures, accuracy benchmarking and AI quality control, provided that reasonable steps are taken to avoid identifying the relevant user or player.

1.7 Security

We implement commercially reasonable safeguards including secure authentication, encrypted transmission where available, access control, role-based permissions, secure cloud infrastructure, monitoring, system maintenance and reasonable administrative controls. However, no internet-based service, cloud platform, AI processing system or digital communication channel can be guaranteed completely secure. Users acknowledge that online data transmission and cloud processing involve inherent risks.

1.8 Data Retention

Personal information will be retained only for as long as reasonably necessary to deliver the services, manage accounts, comply with legal obligations, resolve disputes, maintain business records, support users and enforce agreements. Full uploaded video footage is deleted after analysis, while extracted frames, report elements, generated reports, metadata and account information may be retained for the duration of the user relationship or as reasonably required for service delivery.

1.9 Third-Party Providers

Cricket AI may use third-party providers for hosting, cloud storage, AI processing, payment processing, analytics, email delivery, customer support, cybersecurity, forms and communication. These providers may process information on our behalf and may maintain their own privacy and security practices. Cricket AI will take reasonable steps to use reputable service providers, but is not responsible for independent failures, interruptions, breaches or unlawful conduct by third-party providers beyond our reasonable control.

1.10 POPIA and Consent for Minors

Cricket AI aims to comply with the Protection of Personal Information Act, 2013 (POPIA), and applicable South African privacy principles. Where footage, personal information or performance data relates to a minor, the person submitting the information confirms that they have the necessary authority, parental consent, guardian consent, school consent, academy consent or organisational permission required to upload and process that information. Cricket AI accepts no responsibility for consent failures, unauthorised uploads or disputes caused by users submitting information without the necessary rights or permissions.

2. Terms of Service

2.1 Acceptance of Terms

By accessing, browsing, registering for, subscribing to, booking or using Cricket AI, you agree to be bound by these Terms of Service. If you do not agree with these Terms, you may not use the platform or services.

2.2 Nature of the Service

Cricket AI provides artificial intelligence assisted cricket analysis tools, digital reports, performance insights, technique observations, progress tracking and drill recommendations. The platform is intended as an educational and performance-support tool. Cricket AI does not provide certified coaching, medical advice, physiotherapy advice, sports science certification, biomechanical certification, legal advice, career advice or professional performance guarantees.

2.3 No Performance Guarantees

Cricket AI does not guarantee improved performance, team selection, scholarships, professional contracts, injury prevention, match success, academy acceptance, measurable progress or any specific sporting outcome. Cricket development depends on many factors outside Cricket AI's control, including coaching environment, practice habits, physical condition, player effort, injuries, match conditions, equipment, opposition, selection criteria and personal circumstances.

2.4 AI Limitations

Users acknowledge that artificial intelligence systems have inherent limitations. AI-generated outputs may contain errors, estimation differences, incomplete observations, incorrect measurements, inconsistent scoring, misidentified movements, incorrect recommendations, hallucinations or misinterpretations of footage. Analysis quality may be affected by lighting, camera angle, video quality, frame rate, background movement, clothing, obstruction, player positioning, slow motion, editing, incomplete footage or incorrect user information.

2.4.1 User Acknowledgement of AI Outputs

By using Cricket AI, the user expressly acknowledges and agrees that Cricket AI uses artificial intelligence, machine learning, computer vision and automated analytical systems. AI-generated outputs are probabilistic in nature and are not guaranteed to be correct, complete, consistent, or suitable for any particular purpose. Performance metrics, recommendations, identified weaknesses, improvement areas, drills, player comparisons, rankings, predictions and reports may contain errors or omissions.

Cricket AI does not warrant the accuracy of any AI-generated output. Users must independently evaluate all information before relying on it. Cricket AI shall not be liable for any decision, action, omission, injury, loss, selection outcome, training outcome, sporting performance, financial loss or reputational harm arising from reliance on AI-generated outputs. All AI-generated content is provided on an "AS IS", "AS AVAILABLE" and "WITH ALL FAULTS" basis.

2.5 Mandatory AI Disclaimer for Registration

I acknowledge that Cricket AI provides AI-generated analysis which may contain inaccuracies, estimation errors, incomplete findings, measurement deviations, or incorrect recommendations. I understand that all reports, insights, drills, feedback, and performance assessments are provided for informational and educational purposes only and should not be relied upon as professional coaching, medical, physiotherapy, sports science, biomechanical, legal, or career advice. I accept full responsibility for any decisions made based on information provided by Cricket AI.

2.6 User Responsibilities

Users agree to provide accurate information, only upload footage they are authorised to submit, obtain all necessary consents, use reports responsibly, supervise minors appropriately, avoid unlawful conduct, avoid uploading malicious files, avoid misrepresenting player information, avoid attempting to reverse engineer the platform and avoid interfering with platform operations.

2.7 Intellectual Property

All Cricket AI software, branding, logos, designs, interfaces, algorithms, report templates, scoring structures, analysis methodologies, workflows, text, graphics and platform features remain the property of Cricket AI or its licensors. No rights are granted except those expressly provided for ordinary use of the platform.

2.8 Service Availability

Cricket AI is provided on an as available basis. We do not guarantee continuous uptime, error-free operation, uninterrupted access, compatibility with every device, permanent availability of specific features or uninterrupted third-party integrations. Services may be suspended, limited or changed for maintenance, upgrades, security, operational reasons or circumstances beyond our reasonable control.

2.9 Limitation of Liability

To the maximum extent permitted by law, Cricket AI, its owners, directors, shareholders, employees, contractors, affiliates, academy partners, technology providers and licensors shall not be liable for direct damages, indirect damages, consequential damages, lost profits, lost opportunities, sporting outcomes, injury claims, selection outcomes, reliance on reports, incorrect analysis, AI hallucinations, service interruptions or data loss. Where liability cannot legally be excluded, total liability shall be limited to the fees paid by the user to Cricket AI during the preceding three months.

2.10 Indemnity

Users agree to indemnify, defend and hold harmless Cricket AI, its directors, shareholders, employees, contractors, affiliates, technology providers, academy partners and licensors from any claims, losses, damages, liabilities, costs and expenses arising directly or indirectly from uploaded content, footage ownership disputes, consent disputes, use of reports, user misconduct, breach of these Terms, AI-generated recommendations, incorrect AI analysis, AI hallucinations, automated performance assessments, training recommendations, sporting selection outcomes, injuries allegedly resulting from implementation of recommendations, and reliance on reports or analytical findings.

2.11 Report Disclaimer

Every report generated by Cricket AI should be read together with the following disclaimer: This report was generated using artificial intelligence and computer vision technologies. Results, recommendations, metrics, drills and insights are estimates based on available footage and data and may contain inaccuracies. This report is intended solely for educational and training purposes and should not be relied upon as professional coaching, medical, physiotherapy, biomechanical, sports science, legal or career advice.

2.12 Termination

Cricket AI may suspend or terminate accounts, access or services where there is non-payment, suspected fraud, misuse, unlawful conduct, breach of these Terms, security risk, abuse of the platform or conduct that may harm Cricket AI, other users or third parties.

3. Refund & Cancellation Policy

3.1 Subscription Services

Cricket AI subscriptions renew automatically unless cancelled before the next billing cycle. Users may cancel a subscription at any time. Cancellation prevents future renewals only and does not automatically create a refund for services, time periods, reports, access or features already delivered or made available.

3.2 Monthly Subscriptions

Monthly subscriptions are billed in advance. No refunds will be provided for partial months, unused access, failure to use the platform, change of mind, lack of player activity or disagreement with AI-generated findings. Where a monthly subscription is cancelled, access remains active until the end of the paid billing period unless otherwise suspended for breach of these Terms.

3.3 Cancellation for Future Periods Only

A user may decide to cancel a subscription only for time, months or service periods that have not yet occurred. Cancellation applies to forthcoming periods only. Fees relating to months, days, services, reports, platform access, analysis capacity or subscription benefits that have already occurred, commenced, been made available or been consumed are not refundable unless Cricket AI is required by law to refund them.

3.4 Annual Subscriptions and Discount Recovery

Annual subscriptions are billed in advance and may include discounted pricing compared with month-to-month billing. If a user requests cancellation before the annual term expires, any refund will be calculated by deducting the months that have transpired at the applicable standard monthly rate, deducting any services already consumed, deducting any administrative or payment processing costs where applicable, and reversing the benefit of any annual discount received.

The client remains liable for the discount received on the annual package if the annual package is cancelled before completion of the full annual term. This means the user may not receive both the benefit of discounted annual pricing and an early cancellation refund calculated as if the discounted term had been completed.

Example: If an annual package was purchased at a discounted price and the user cancels after several months, Cricket AI may recalculate the used months at the normal monthly price, deduct the value of any reports or services already consumed, deduct the discount benefit already received and refund only the remaining balance, if any.

3.5 Analysis Events

Event bookings may be refunded at Cricket AI's discretion according to the event-specific rules communicated at booking. Unless otherwise stated in writing, cancellations more than fourteen days before the event may qualify for a full refund, cancellations between seven and fourteen days before the event may qualify for a fifty percent refund, and cancellations within seven days of the event are not refundable. Substitutions may be allowed at Cricket AI's discretion.

3.6 Completed or Commenced Analysis

Once an analysis has commenced, footage has been processed, a report has been generated, or AI processing capacity has been used, the service is deemed delivered. No refunds will be granted merely because a user disagrees with AI findings, expected different results, did not improve, was not selected, did not use the report or later decided the analysis was no longer required.

3.7 Failed Uploads or Platform Faults

Where analysis cannot be completed due to a verified Cricket AI system fault, Cricket AI may, at its discretion, reprocess the footage, request a new upload, issue service credits, extend access or provide a refund for the affected analysis. Cricket AI is not responsible for failures caused by poor internet connectivity, corrupted files, unsupported formats, user error, inadequate footage, incorrect camera angle, poor lighting or third-party platform outages outside our control.

3.8 Chargebacks and Disputes

Users agree to contact Cricket AI at info@cricketai.co.za to resolve billing or service disputes before initiating chargebacks. Fraudulent chargebacks, repeated payment disputes or unpaid balances may result in account suspension, cancellation of access, recovery action or refusal of future services.

3.9 Changes to Policies

Cricket AI reserves the right to amend these policies at any time. Updated versions will be published on the website and become effective upon publication unless otherwise required by law.
